SUCCESSFUL OUTCOMES...A Q&A with DAN CAPRON
What is your area of concentration within your law practice?
My area of concentration is worker’s compensation. I do one thing. I try to do it very well. I'm not a generalist.
How do you measure success?
Success is not always measured solely in the area of the amount of the award. Many times, success can be measured in having to avoid going to arbit-ration altogether. Arbitration is not always the best result for any particular client. Many times settlement is a better result. So part of the craft of doing very well in this area of law is knowing how to get from point A to point B most effectively and most efficiently for your particular client.
What is your ultimate goal for your client?
For one claimant, it might be a relatively simple case, where all we're looking to do is to get the largest possible settlement at the end. For another client, success might be best determined by getting the claim to be acknowledged by the insurance carrier as compensable to begin with. For another client, it might be to get a surgery authorized, or a particular medical procedure authorized. For another client, it might be to get lost time benefits because the person is in dire straits, unable to work, and not receiving weekly checks.
